Terms of service
Last updated: 15 October 2026
These terms govern your use of this website and any purchase you make from it. Please read them before ordering, and in particular sections 9 to 12, which deal with safe use, risk and the limits of our liability. By placing an order you agree to be bound by these terms.
1. Who you are dealing with
- Name: Stephan Nel
- Trading as: Throttle Dynamics
- Legal status: Sole proprietor. Throttle Dynamics is not a registered company and has no company registration number.
- Physical address: 1 Wisteria Crescent, Centurion, Gauteng, 0172
- Telephone and WhatsApp: +27 64 502 8725
- Email: throttledynamicsza@gmail.com
- Website: https://throttledynamics.co.za
We are an online store only. The address above is for correspondence and for returns we have arranged with you; it is not a walk-in store.
This information is provided in accordance with section 43 of the Electronic Communications and Transactions Act 25 of 2002 ("ECTA").
We are not registered for Value-Added Tax. Our prices do not include VAT and we do not issue tax invoices. We issue an order confirmation and proof of purchase for every order.
2. Our products
We sell electronic throttle controllers for specified vehicle makes and models. The device connects in line with your vehicle's existing accelerator pedal connector and changes how quickly the pedal signal is passed on.
- It does not increase your engine's power, torque or fuel efficiency.
- It changes the response curve between your foot and the throttle body, reducing or increasing perceived delay depending on the mode selected.
- It is designed to be reversible: it can be unplugged and the factory connector restored.
3. Fitment is model-specific
Each controller is matched to a particular vehicle make, model and generation, and will not necessarily fit another. It is your responsibility to select the correct product. The fitment is published on every product page, and we will gladly confirm it before you order: send your vehicle's make, model, year and engine to +27 64 502 8725 on WhatsApp or to throttledynamicsza@gmail.com.
If you order the wrong product without checking with us, our change-of-mind return terms apply. If we confirmed a fitment to you and it turns out to be wrong, we bear the cost of putting it right.
4. Orders and when a contract is formed
Product listings are an invitation to do business, not an offer. Placing an order is an offer by you to buy. A binding contract comes into existence when we accept your order by dispatching the goods.
We may decline or cancel an order before dispatch — for example where an item is out of stock, a price or description was published in error, we cannot deliver to your address, we have not received your payment in time, or we reasonably suspect fraud. If we do and you have paid, we refund you in full. See our Cancellation Policy.
5. Prices and payment
- All prices are in South African Rand (ZAR).
- Delivery anywhere in South Africa is included in the price of every product. There is no separate delivery charge and no minimum order value.
- The price that applies is the price displayed when you place your order.
- We accept payment by card (Visa or Mastercard) or by EFT (bank transfer).
- Card payments are processed securely by our payment provider, Paystack, on our checkout page. We never receive or store your full card details.
- EFT payments: after you place your order, our bank details are shown on your order confirmation page and in your confirmation email. Use your order number (for example TD1001) as the payment reference, so we can match your payment to your order.
- We process and dispatch your order once payment is confirmed. Card payments are confirmed immediately. EFT payments are confirmed once the full amount reflects in our bank account; payments from other banks usually take 1–2 working days to clear. A proof-of-payment slip on its own is not treated as payment.
- If we have not received your EFT payment within 3 working days of your order, we may cancel the order and release the stock. See our Cancellation Policy.
- Our bank details will never change by email or message. If you receive a message asking you to pay into a different account, do not pay; contact us on +27 64 502 8725 to confirm.
If an obvious pricing error occurs, we will contact you before dispatch and you may either confirm the order at the correct price or cancel it for a full refund.
6. Delivery
We deliver within South Africa only. We dispatch within 1–3 working days of your payment being confirmed, and the courier transit times in our Delivery Policy are estimates, not guaranteed delivery dates. The Delivery Policy forms part of these terms.
7. Cancellation, returns and refunds
Your rights are set out in our Cancellation Policy and our Refund and Returns Policy, which form part of these terms. Nothing in these terms limits your rights under the Consumer Protection Act 68 of 2008 ("CPA") or ECTA, including:
- your right under section 44 of ECTA to cancel within seven days of receiving the goods, without reason or penalty; and
- your right under section 56 of the CPA to return goods that are defective, unsafe or not of good quality within six months of delivery, and to choose whether they are repaired, replaced or refunded.
8. Warranty
We provide a two-year warranty against defects in materials and workmanship, from the date of delivery. This is a voluntary warranty in addition to your statutory rights under the CPA, not instead of them.
It does not cover damage caused by incorrect installation, physical damage, water ingress, unauthorised repair or modification, use on a vehicle the controller was not sold for, or ordinary wear to cables and connectors.
To claim, contact throttledynamicsza@gmail.com or WhatsApp +27 64 502 8725 with your order number and a description of the fault.
9. Safe use
This product changes how your vehicle responds to the accelerator pedal. You must:
- install the device only with the vehicle stationary, switched off and safely parked;
- not adjust settings while driving — stop safely first;
- get used to the changed response in a safe, quiet place before driving in traffic;
- choose a mode suited to the conditions — higher-response modes may be unsuitable on wet or loose surfaces, when towing, when heavily loaded, or when driving off-road at low speed; and
- comply with the National Road Traffic Act 93 of 1996 and all road traffic regulations.
10. Vehicle warranty and service plans
The device is fitted in line at the factory accelerator connector and can be removed without cutting, splicing or permanent alteration. However, we do not control the decisions of vehicle manufacturers, dealers or motor plan providers, and we cannot promise that fitting an aftermarket accessory will have no effect on your vehicle warranty, motor plan or service plan. If this concerns you, check your plan's terms or ask your dealer before fitting. You may remove the device before a dealer service.
11. You fit and use the product at your own risk
IMPORTANT — THIS CLAUSE PLACES RISK ON YOU. PLEASE READ IT CAREFULLY.
Fitting a throttle controller is your choice, and you fit and use it at your own risk. In particular, you accept that:
- a changed throttle response alters how your vehicle behaves, and a driver who is not yet used to it may misjudge acceleration, especially when first using the device, in low-traction conditions, or when towing;
- you, as the driver, remain solely responsible for the safe control of the vehicle at all times;
- you are responsible for installing the device correctly, following our instructions; and
- any effect on a manufacturer's warranty, motor plan or service plan is a matter between you and that provider (see section 10).
12. Limitation of our liability
IMPORTANT — THIS CLAUSE LIMITS WHAT YOU CAN CLAIM FROM US.
To the maximum extent permitted by law, our total liability to you for any claim relating to a product, whether in contract, delict or otherwise, is limited to the price you paid for that product. In practice this means that the most you can recover from us is a full refund.
To the same extent, we are not liable for indirect or consequential loss, including loss of income, loss of use of a vehicle, or the cost of towing, vehicle hire or recovery.
Nothing in this section or anywhere in these terms excludes or limits any liability that the law does not allow to be excluded or limited, including liability under section 61 of the CPA for harm caused by unsafe or defective goods, liability for loss caused by gross negligence (section 51(1)(c) of the CPA), or liability for fraud.
13. Intellectual property
All content on this website, including text, images and the Throttle Dynamics name and branding, belongs to us or our licensors and may not be copied or reproduced without written permission.
14. Privacy
We process personal information in accordance with the Protection of Personal Information Act 4 of 2013. See our Privacy Policy.
15. Complaints and dispute resolution
If something has gone wrong, please contact us first on +27 64 502 8725 (WhatsApp) or throttledynamicsza@gmail.com — we would far rather fix it directly.
If we cannot resolve your complaint, you may refer it to the Consumer Goods and Services Ombud or the National Consumer Commission. Doing so does not affect your right to approach a court.
16. General
- These terms are governed by the laws of the Republic of South Africa.
- If any provision is unenforceable, the remaining provisions continue in force.
- We may update these terms. The version published when you place your order applies to that order.
- Our failure to enforce any provision is not a waiver of it.
